Although the principle of freedom of contract is a fundamental principle of Greek law, in the field of company law, private will cannot create companies with arbitrary characteristics or forms by combining various corporate elements.
In other words, our company law establishes a “numerus clausus”, namely limited number of company types governed by specific rules of establishment, operation and organization, for the sake of protecting both the partners themselves and third parties who deal with the legal person in question.
Companies are divided into partnerships and limited liability companies, the main criterion being the link between the partners' personal assets and the company's assets and liabilities, although not all types of company can be fully classified in one or other of these categories.
